  1. This Privacy Policy contains information concerning the principles of processing and protection of personal data of entities using the website (hereinafter: “Users”) owned by Michał Soltysik CyberWave, located at michalsoltysik.com (hereinafter: “Website”) and the cookie policy.
  2. The administrator of the personal data provided by the Users is Michał Sołtysik CyberWave based in Poznań at Tamka 16/32 Street, 00-349 Warsaw, NIP: 6492190913, hereinafter referred to as the “Administrator”.
  3. The processing of personal data is carried out in accordance with the principles set out in the Personal Data Protection Act of 10 May 2018 and the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation).
  4. The acquisition of information about Service Users and their behaviour is carried out as follows:
    1. through the data voluntarily entered by Users in the electronic forms on the Website (in the so-called sidebars, contact forms and free quote forms) or the live chat web application forms,
    2. by storing cookies (so-called “cookies”) on terminal equipment,
    3. by the collection of web server logs by the hosting operator.

Other parameters may be recorded, such as the time of the request and response, errors encountered, information about the user’s IP address and the browser used. All collected data is not linked to specific persons browsing the Website, and its use is solely for the purpose of efficient server administration.

  1. The processing of the Service User’s personal data referred to in § 1.4 above shall only take place for the purpose for which this data was entered by the Service User into the Service with his/her prior consent, including:
    1. in order to prepare a quotation for the service and send you a commercial offer,
    2. in order to handle a request, contact or reply to a message sent by a Service User,
    3. the fulfilment of the Administrator’s obligations imposed on it by law,
    4. the fulfilment of the legitimate purposes (e.g. carrying out marketing activities) pursued by the Controller or by the recipients of the data, which does not prejudice the rights and freedoms of the data subject.

Recipients of personal data of the Service Users are entities cooperating with the Administrator to the extent necessary to achieve the purposes indicated in § 4.1 above, as well as entities processing data on our behalf, i.e. entities operating IT systems, entities providing consultancy, accounting and legal services.

The Administrator is responsible for the use of appropriate technical and organisational measures to ensure the security of the data provided by Service Users, in particular to prevent access to them by third parties or their processing in violation of the law, to prevent data loss, damage or destruction.
  9. Users of the Service have the right to lodge a complaint with a supervisory authority if they consider that the processing of their data violates the General Data Protection Regulation of 17 April 2016.
  10. Service Users have the right of access to the content of their personal data and the right to rectification, restriction of data processing, the right to data portability, data deletion, the right to object and to withdraw consent at any time without affecting the lawfulness of the processing carried out on the basis of consent before its withdrawal.

Purposes of personal data processing and legal basis for processing:

The processing of your personal data will take place:

  1. for the purpose of concluding a contract for services on the basis of interest in our offer (basis of Article 6(1)(b) of Regulation (EU) 2016/679/EU of the European Parliament and of the Council of 27.04.2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation) (Official Journal of the EU L 119, p. 1) – hereinafter GDPR;
  2. for archival (evidential) purposes in pursuit of our legitimate interest in preserving information in the event of a legal need to prove the facts (Article 6(1)(f) GDPR);
  3. for the purposes of possible establishment, investigation or defence against claims being the exercise of our legitimate interest (basis of Article 6(1)(f) of the DPA);

Period of retention of personal data:

Personal data resulting from the conclusion of the contract will be processed for the period in which claims related to the contract may arise, in accordance with the principles of document archiving specified by the Act of 14.07.1983 on the national archival resource and archives (Journal of Laws No. 38, item 173, as amended).

If a contract is not concluded within 14 days of us making you an offer, personal data relating to discussions about this contract will be deleted immediately, with the exception of data needed for direct marketing insofar as you have given your consent to the processing of data for this purpose.
  3. Data processed for the purposes of direct marketing of our products and services will be processed until an objection is raised against the processing. Right of access to personal data:

  1. Your provision of personal data is a condition for the conclusion of the contract and failure to do so will result in the impossibility of concluding the aforementioned contract.

  1. Your personal data may be disclosed to other entities; our partners, i.e. companies with whom we cooperate by bundling products or services.
  2. The data may also be accessed by our subcontractors (processors), e.g. accounting firms, law firms, IT firms, claims adjusters, loss adjustment contractors.
